• basic technical information used by the website provider to operate and secure the siteIf I accept a medico legal instruction, I may also receive and create information needed for the case. This may include identity and contact details, medical and health information, care, employment or education records, legal documents, correspondence, assessment notes, reports and billing records. Health information is special category personal data and receives additional protection.Please do not send medical records or other sensitive case documents through the website enquiry form. I will agree a suitable method for transferring them if an instruction proceeds.Where the information comes fromInformation may come directly from you or from an instructing solicitor, insurer, legal representative, court, tribunal, healthcare professional, employer, records provider or another person involved in the case.How and why I use informationI use personal information to:• respond to enquiries and decide whether I can accept an instruction, including checking for conflicts of interest

• meet legal, regulatory, professional, court and tax requirementsDepending on the circumstances, my lawful bases are taking steps before entering into a contract, performance of a contract, compliance with a legal obligation, and my legitimate interests in running and protecting my practice and providing professional services.Where health or other special category information is used for medico legal work, the additional condition is generally that processing is necessary for the establishment, exercise or defence of legal claims.I do not normally rely on consent for processing that is necessary for medico legal work. If I ask for consent for a separate purpose, you may withdraw it at any time without affecting earlier lawful use.Who I may share information withWhere necessary and lawful, information may be shared with:• the instructing organisation, solicitors, insurers, legal representatives, courts, tribunals and parties to proceedings
• healthcare professionals, other experts or records providers, where authorised or required
• my professional advisers, indemnity insurer, accountant, regulators or law enforcement bodies
• service providers supporting the website, enquiry form, email, secure storage, IT and business administrationI only share what is reasonably necessary and I do not sell personal information.International transfersSome technology providers may process information outside the United Kingdom. Where this happens, I take steps to ensure that an appropriate UK data protection safeguard is in place.How long I keep informationEnquiries that do not lead to an instruction are normally kept for up to 12 months after the last contact.Medico legal case records are normally kept for up to seven years after the case closes, unless a longer or shorter period is required by law, a court, professional guidance, insurance requirements or the terms of the instruction.Financial and tax records are kept for the period required by law. Information is securely deleted or destroyed when no longer needed.SecurityI use proportionate technical and organisational measures to protect personal information. Access is limited to those who need it for a legitimate purpose. No method of electronic transmission or storage is completely risk free.Your data protection rightsDepending on the circumstances, you may have rights to request access to your information, correction, erasure, restriction, objection or transfer of information.
